It is commonly assumed that married couples or civil partners have a combined inheritance tax free threshold of £650,000 (Jan 2010). Hence if the final estate is £650,000 or less they assume that their children’s inheritance is safe from inheritance tax…...not necessarily so!
The Facts
Married Couples and Civil Partners effectively have exactly the same IHT threshold as single people; £325,000 each (Jan 2010).
When the first spouse / civil partner passes away there is no inheritance liability spouse to spouse, civil partner to civil partner. It is on the passing of the remaining spouse / civil partner where any IHT liability now becomes an issue.
In order to benefit from the FULL £650,000 threshold the final estate must PROVE any unused portion of the first spouse / civil partner’s IHT threshold at the time they passed away.
If they can prove any unused portion of that threshold it is carried forward to the estate of the second spouse / civil partner where it will be taken into account when IHT liability is assessed on the final estate ......Clear as mud?
There is one thing crystal clear; if you cannot prove the unused portion then YOUR ESTATE WILL BE TAXED accordingly!
